Sale & Reservation Terms
The terms of sale.
Plain South African contract terms for purchasing or reserving a Prodiam piece. These terms apply alongside the Consumer Protection Act 68 of 2008 (“CPA”) and FICA / POPIA where relevant.
1. Who you’re contracting with
Prodiam Trading CC, Suite F1W6, The Paragon, 1 Kramer Road, Bedfordview, Johannesburg, 2007. For diamonds, the bench-of-origin is D and D Diamonds CC (Reg. 2002/018001/23), trading as Procut DCW, Suite F1W6B at the same address.
2. Pricing, transparent and final
- Prices are quoted in ZAR, exclusive of 15% VAT, exclusive of delivery and insurance, and exclusive of customs duty for international buyers.
- Prodiam does not apply discount codes, sale-day reductions, promo bundles, or any after-the-fact downward price negotiation. The price you see is the price.
- Prices may move between catalogue refreshes as rough costs and ZAR/USD rates move. The price quoted in your reservation confirmation is the price honoured for that 72-hour window.
3. Reservations
- Adding a piece to your reservation register is a soft hold while you finish browsing. It is local to your browser only.
- Submitting the Settlement form converts your soft register into a 72-hour locked reservation against the specific pieces. During that window the pieces are removed from public listing.
- If settlement does not complete within 72 hours, the reservation lapses and the pieces return to inventory. We will message you beforehand.
4. Settlement methods
- EFT bank wire (ZAR), most common above R 250 000.
- SWIFT international wire (USD / GBP / EUR / CHF), settled to ZAR.
- Yoco card (PCI-DSS compliant, hosted page).
- PayFast (PCI-DSS Level 1, card / instant-EFT / Zapper / SnapScan / MobiCred).
- In-person at the Bedfordview viewing room.
Stones ship on cleared funds. For card and instant-EFT we treat authorisation as cleared. For bank wires we wait for the credit to reflect.
5. FICA / KYC
For pieces above R 25 000 we are required by law to verify identity. We will request a copy of your SA ID / passport and a recent proof of address. These documents are stored encrypted, used only for FICA compliance, and retained per the schedule in our Privacy Notice.
6. Delivery, insurance, and risk
- Risk passes to the buyer on collection or signed handover to a nominated insured carrier.
- Domestic SA shipments are insured via Brink’s, G4S, or our nominated jewellery courier. International shipments via Ferrari Group or FedEx Custom Critical, both jewellery-grade insured.
- Insurance is included up to the invoice value unless the buyer elects extra coverage in writing before dispatch.
7. Returns & CPA cooling-off
In line with the Consumer Protection Act, distance-sale buyers (purchases not made in person) are entitled to a 7-day inspection period from delivery, during which the piece may be returned in its original sealed condition for a full refund less return-shipping. Pieces engraved or sized to specification are excluded as they are bespoke (CPA s44(1)(b)). In-person sales at the viewing room are final-sale, with the certificate of inspection signed across at collection.
8. Manufacturing, recutting, and repair guarantees
Every Prodiam piece carries a one-year complimentary service (clean, check, retighten claws). Manufacturing defects discovered within 24 months are repaired or replaced at our cost. Damage from wear, impact, or third-party work voids this guarantee. The diamonds themselves carry no defect guarantee, they are natural stones certified to a published GIA grade.
9. Dispute resolution
We aim to resolve any complaint within 14 working days. Failing that, the matter may be referred to the SA Consumer Goods and Services Ombud (cgso.org.za), the Jewellery Council of South Africa Ethics Committee (jewellery.org.za), or the National Consumer Commission. Governing law: Republic of South Africa.
10. Force majeure
Performance is excused where prevented by events outside reasonable control, including SADPMR audit holds, banking outages, unrest, or pandemic-era restrictions. The 72-hour reservation window pauses during such events.
